How often do criminal cases go to trial?

Over 90 % of criminal cases are resolved short of trial. If the prosecutor and defense attorney properly analyze the case and understand the risk of trial, they typically can work out a resolution that works for everyone. Most cases are resolved with a plea bargain to a lesser charge. Sometimes the plea bargain will include a sentence bargain. A sentence bargain put a cap on jail time, fines, or restitution. Ultimately the court cannot accept a plea to a crime that was not committed.
